Del. Governor Jack Markell vetoes incinerator bill–SB 311

Today is a Code Yellow bad air day.  Tomorrow is a Code Orange bad air day.   In general, the air is very bad in Delaware these days.

Senate Bill 311, as we reported here, passed through the Delaware General Assembly with only one "no" vote.  This bill clarified that "wood" burning is considered incineration under Delaware’s anti-incinerator laws.  "Synopsis: This Act is intended to close a potential loophole in Title 7, which could allow industrial incinerators capable of incinerating solid waste to operate near residential areas by burning wood."

Nonetheless, Governor Jack Markell vetoed it today, July 19th, with this published statement:

"Environmental Bill Would Limit Clean Technology…"

"Senate Bill 311

sought to improve environmental quality and public health by expanding the state�s existing incinerator ban to include a blanket ban on wood-powered incinerators, a type of biomass energy.  The ban may actually reduce efforts to curb pollution, however, as new technologies around biomass have the potential to replace significant sources of pollution with cleaner, renewable energy. Instead of a lifetime prohibition that could also limit these new, cleaner technologies, the Governor believes pollution reductions and environmental improvements would be better achieved through a case-by-case, science-based permitting process."

Statement from Alan Muller of Green Delaware:

"The Markell administration supported a highly-polluting, now-abandoned wood burner project in Newport, Delaware, and ignored our correspondence about this problem.

Now, Markell has vetoed a bill intended to ensure that other Delaware communities don’t have to go through the same struggles. 
Given the near-unanimous support for SB 311, a veto override would be expected.  But the General Assembly is not in session.
I cannot begin to adequately express my shame and regret at having personally supported Markell for governor.  The people are getting screwed in one way after another.
